Information on the external reporting office of atempo and CFS

Why does this reporting office exist?

Employees can report if laws or regulations of the European Union are not complied with. If atempo or CFS do not comply with European Union laws, employees can report this.

 

The European Union is abbreviated as EU.

 

All companies with more than 50 employees must have such a reporting office. This is set in a law called the Whistleblower Protection Act.

 

Whistleblowers are people who point out when rules are not being followed.

What should be reported here?

The Whistleblower Protection Act is about rules from the EU. Misconducts on the following topics should be submitted to this reporting office:

  • Awarding of public contracts
  • Misuse of subsidies
  • Corruption
  • Money laundering
  • Environmental protection
  • Health protection
  • Animal protection
  • Data protection
  • Customer protection.

What should NOT be reported here?

The reporting office is not designed for customer complaints. It is also not designed for general complaints from employees. Such complaints should be reported to the management or the works council.

When are you protected? When are you not?

If you make a report, the company must not punish you for it.

 

No one may be terminated for this reason, for example.

 

If the report is correct, you are not liable for the consequences of the report for the company.

 

But if you deliberately make a false report, you can be punished for it.

 

A person who supports others in reporting is also protected. For example, a colleague.

How can I make a report?

There are 2 ways to submit your report:

 

  1. You can notify the company. This means report directly to Mario Morschner. He is authorized by atempo and CFS to accept reports.

Mario Morschner and the external reporting office may only pass on the name of the reporting person if this person gives permission.

What happens then?

Mario Morschner or the external reporting office must check the report. They must reply to the reporting person within 7 days. For example, by e-mail or letter. And they must keep the report and the reply for 5 years.

 

This allows you to check later whether everything has been handled correctly.

What happens after the notification?

The answer may be:

  • We investigated the tip and did nothing. We did so for one of these 3 reasons.
    It may be that the person who made the report has no professional connection with atempo or CFS.
    Secondly, because the report has nothing to do with EU law.
    Or thirdly, because the report was wrong.

 

The answer could also be this:

  • We have investigated the report and taken the necessary steps.
    The company can tell the whistleblower what action it has taken. However, it does not have to do so.

What else is important?

For the company to check a tip, it may need to question other employees in the company. For example, from the accounting department or a division manager. However, these employees are not allowed to tell their colleagues or other people about this. They must also sign a confidentiality agreement.
